Welcome to the SwellMate beta.
SwellMate is an experimental surf forecasting and alert service designed to help surfers understand forecast conditions at selected surf spots.
By creating a SwellMate account and accepting these Beta Terms, you agree to the following.
SwellMate is currently under development and is being provided for testing and evaluation.
Features may be incomplete, inaccurate, unavailable or change without notice. The service may contain bugs or technical errors. Forecasts may fail to update, alerts may arrive late or not arrive at all, and information or user data may occasionally be lost.
There is no guaranteed level of availability, reliability or performance.
During the beta, SwellMate may add, modify, suspend or remove features at any time.
Surfing and other ocean activities are inherently hazardous and may result in serious injury or death.
Ocean conditions can change rapidly and may differ substantially from forecast conditions.
Hazards can include powerful or unexpectedly large waves, rip currents, changing tides, wind, rocks, reefs, shallow water, shorebreaks, marine life, pollution, severe weather, other water users and local hazards that SwellMate does not know about or display.
SwellMate does not determine whether it is safe for you to surf.
You are responsible for assessing actual conditions at the location, your own surfing and swimming ability, your equipment, and any warnings or instructions from lifeguards and competent authorities before entering the water.
Never rely exclusively on SwellMate when making a safety-related decision.
SwellMate combines and interprets weather, marine, swell, wind, tide and other data to estimate surf conditions.
Forecasts are predictions, not guarantees.
Actual wave height, wave quality, wind, tides and other conditions may differ significantly from the information shown by SwellMate.
A good rating, high score, favourable forecast or positive description does not mean conditions are safe.
SwellMate does not guarantee that a surf spot will be working, that predicted conditions will occur, or that conditions will be appropriate for your ability.
SwellMate may personalize forecasts using information you provide, such as your surfing level, preferred spots, equipment, preferences and previous session feedback.
Personalization is an estimate.
A classification such as Beginner, Intermediate or Advanced cannot fully represent your experience, swimming ability, fitness, judgment or ability to handle particular ocean conditions.
SwellMate does not independently assess or verify your surfing ability.
A forecast that appears suitable for your profile therefore does not mean that SwellMate has determined that you can safely surf those conditions.
SwellMate may send you forecasts, notifications or surf alerts.
An alert means only that SwellMate’s system identified forecast conditions matching certain criteria.
An alert does not mean “go surfing”, “the surf is safe”, or that you should enter the water.
Conditions can change between the time forecast data is collected, processed, sent to you and the time you reach the surf spot.
Alerts can also be delayed, incorrect, duplicated or not delivered.
You remain responsible for deciding whether, when and where to surf.
SwellMate relies partly on weather, marine, tide, mapping and other information supplied by third parties.
Third-party data may be inaccurate, incomplete, delayed or unavailable.
SwellMate may combine, transform, interpolate or score this information to produce its own forecasts.
We cannot guarantee the accuracy or availability of either the underlying third-party data or forecasts derived from it.
SwellMate uses artificial intelligence and automated systems. When you interact with the SwellMate assistant or chatbot, you are interacting with an AI system, not a human surf forecaster.
AI may be used to explain forecasts, answer questions, personalize information and generate other parts of the Service.
AI-generated responses can be incorrect, incomplete or misleading.
Nothing said by the SwellMate AI assistant should be treated as professional meteorological, maritime, rescue or safety advice.
In particular, conversational language generated by the AI does not override the warnings and limitations contained in these Terms.
During the beta, you may choose to provide session ratings, tags, observations, surf reports, comments or other feedback.
You retain ownership of content you create.
By submitting content to SwellMate, you grant SwellMate a non-exclusive, worldwide, royalty-free licence to store, process, analyze and use that content for operating, testing, developing and improving SwellMate.
If SwellMate later wishes to publicly display your reports or share identifiable user-generated content with other users, additional controls or permissions may be provided where required.
Do not submit content that you do not have the right to provide.
SwellMate is an informational and recreational forecasting tool.
It is not an emergency service, rescue service, maritime navigation service, professional meteorological service or professional safety service.
SwellMate should not replace official weather or maritime warnings, beach flags, lifeguards, emergency authorities or your own assessment of conditions.
If SwellMate information conflicts with an official warning or instruction, rely on the competent authority.
The current SwellMate beta is provided free of charge.
No subscription or paid service is created by accepting these Terms.
If paid plans are introduced in the future, the applicable price, renewal, cancellation and payment terms will be presented separately before you purchase them.
To the fullest extent permitted by applicable law, the SwellMate beta is provided “as is” and “as available”, without guarantees regarding its accuracy, reliability, availability or suitability for a particular purpose.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights or protections provided by mandatory consumer law.
Subject to those mandatory rights, SwellMate is not responsible for losses resulting from reliance on inaccurate forecasts, changes in actual conditions, unavailable or delayed alerts, third-party data errors, service interruptions or decisions about whether, when or where to surf.
Where liability cannot lawfully be excluded but can lawfully be limited, SwellMate’s aggregate liability arising from the free beta service will be limited to €100, or the minimum greater amount required by applicable law.
This limitation does not apply where applicable law prohibits such a limitation.
Nothing in these Terms transfers responsibility for assessing actual ocean conditions or deciding whether to enter the water from you to SwellMate.
Use of SwellMate involves the processing of personal information.
Our Privacy Policy explains what information we collect, why we use it, which service providers may process it, how long it may be retained and what rights you have.
The Privacy Policy is available separately from these Terms.
Where applicable law requires your consent for particular processing, that consent will be requested separately.
You may not deliberately interfere with the Service, attempt unauthorized access, misuse other users’ accounts, systematically extract SwellMate data, use the Service unlawfully or attempt to disrupt its operation.
Access to the beta may be suspended or terminated where reasonably necessary because of misuse, security concerns or violation of these Terms.
SwellMate will continue to evolve during testing.
These Terms may therefore change.
If we make material changes, we may ask you to review and accept a new version before continuing to use SwellMate.
The version and date shown at the top identify the Terms that apply to your use of the Service.
You can stop using the SwellMate beta at any time.
You may request deletion of your account and associated personal information, subject to information that may lawfully or necessarily be retained, as explained in the Privacy Policy.
We may also discontinue the beta or suspend access where reasonably necessary.
SwellMate forecasts surf conditions. It does not determine whether the ocean is safe.
Conditions can change quickly. Check the actual conditions, consider your own ability and equipment, and follow official and local warnings before entering the water.
